Heard Mr. S.R Mohanty, on behalf of Mr. S.Das, learned counsel appearing for the Petitioner.

After arguing for some time, since this Court has already observed that no right has been accrued in favour of the second highest bidder i.e. the petitioner, learned counsel for the petitioner wants to withdraw the writ petition with liberty to pursue the remedy by filing an appeal under Rule 46 of the OMMC Rules, before the appropriate forum.

In view of such submission, the Writ Petition is disposed of as withdrawn with the aforesaid liberty.
