Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody in connection with Kishorenagar P.S. Case No.94 of 2020 corresponding to Special (POCSO) Case No.39 of 2020 pending in the Court of learned Addl. District & Sessions Judgecum-Special Court under POCSO Act, Angul for the alleged commission of offence under Section 376(3) of IPC read with Section 4 of POCSO Act.

It is alleged that the petitioner committed rape on the victim, who is a deaf and dumb girl. As it appears trial is in progress, in course of which, the victim is examined as P.W.-1 5.

Having regard to the testimony of the victim and other materials on record which reveal a strong prima facie case against the petitioner, I am not inclined to allow the prayer for bail, which is therefore, rejected.

BLAPL is accordingly rejected.
