This matter is taken up through hybrid mode.

The Petitioner in this writ petition prays for the following relief:

"Therefore, it is humbly prayed that your Lordship's would be graciously pleased to issue rule "NISI"

in the nature of writ of Mandamus/Certiorari or any other appropriate writ/writs calling upon the Opp. Parties:

i) To show cause as to why the registered sale deeds of the Petitioner which has been cancelled by the Sub-Registrar, Athagarh, the Opp. Party No.2 through the registered deed of cancellation vide annexure-5 & 6 in the lack of any specific provision and at the instance of Opp. Party Nos. 3 and 4 shall not be declared as illegal and invalid documents and accordingly, direction be made to the Opp. Party No.2 to restore the annexure-3 and 4 to its original position.

ii) And if the Opp. Parties show false cause or insufficient cause or no cause the aforesaid Rule "NISI" may be made absolute.

iii) And accordingly allow the writ petition. And any other order/orders/direction/directions may be made on the facts and circumstances of the case.

In course of hearing, learned counsel for the Petitioner prays for withdrawal of the writ petition to enable him to avail the remedy in the common law forum.

In view of such submission, this writ petition is disposed of as withdrawn.
