1. Heard learned counsel for the Petitioner and the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in anticipation of arrest for her alleged involvement in the offences U/s.448/379/323/294/506 IPC.

3. Mr. D. Panda, learned counsel for the Informant submits that he has instructions and it is reasonably believed that the leaned counsel for the Petitioner has been consulted by the Informant side at some point of time and as such ethically the Counsel ought not have appeared on behalf the Petitioners.

4. The learned State counsel however submitted that he has instructions in connection with the matter to the effect that the Purighat P.S. has initiated the process under Section 41A Cr.P.C.

5. In such view of the matter, there is no point in proceeding with this application. In case, however, no such initiation has been made

// 2 // the concerned I.O shall take recourse as would be permissible under law.

6. With the above observation, the present application is disposed of.
