Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with G.R. Case No.488 of 2022, pending in the Court of the learned J.M.F.C. (City), Cuttack, arising out of Chauliaganj P.S. Case No.121 of 2022, for alleged commission of offences under Section 394 of IPC. 3.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional Sessions Judge, Cuttack, by order dated 02.11.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the commencement of trial and the criminal proclivity of the petitioner, this Court is not inclined to entertain this bail application at this stage, since this Court is of the considered opinion that releasing the accused-petitioner at this stage, will affect the impending trial.

Learned Court in seisin over the matter is requested to expedite the trial and conclude the same within a period of three months from the date of receipt/production of the copy of this order. 6.

In the event trial is not concluded within the time stipulated, it shall be open to the petitioner to renew his prayer. 7.

Accordingly, the BLAPL stands disposed of.
