Heard learned counsel for the petitioner and learned counsel for the Opposite Parties.

The petitioner is an accused in C.T. (Spl) Case No.48 of 2022, pending in the file of learned Additional Sessions Judge-cumJudge Special Court Kamakhya Nagar, arising out of Kamakhya Nagar P.S. Case No.280 of 2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional District and Sessions Judge-cum-Special Court Kamakhyanagar by order dated 10.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the petitioner is in custody since 27.07.2022 and the charge sheet is placed on record dated 21.10.2022 indicating that the petitioner has been implicated under Section 342 /354-B/376(2)(n)/417/323 of the IPC.

It is apt to note that the Sections relating to SC & ST (PoA) Act has been deleted in the charge sheet though the accusation was initially under the said sections. 6.
Perused the 164 Cr.P.C. statement of the victim. 7.
Considering the tenor thereof and period of custody, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.

Accordingly, the BLAPL stands disposed of 9.
Urgent certified copy of this order be granted as per the rules.
