This matter is taken up through Hybrid Arrangement Order No.
(Virtual/Physical Mode).

This IA has been filed by the Opposite Parties seeking modification of order dated 10.11.2022.

Learned Additional Standing Counsel submitted that the order of this Court has been complied with, however, while complying the said order because of the procedural requirement there was some delay in disbursing the financial benefits as was due and admissible to the petitioner. In such view of the matter, learned Additional Standing counsel submitted that the interest portion of the order dated 10.11.2022 be kept in abeyance. 4.
Learned counsel for the petitioner on the other hand contended that payment of interest for delayed payment is accrued in favour of the petitioner. Therefore, the same cannot be taken away
// 2 // by the State Authorities by filing the present modification application.

Considering the submissions made by learned counsels appearing both sides this Court keeping in view the background facts as well as surrounding circumstances, is of the considered view that interest rate which was earlier granted interest @ 18% stands modified to 7%. It is further made clear that payment of interest at 7% as has been modified by the present order shall be confined to the present petitioner only and this shall not be applicable to other case.

Accordingly, the I.A. stands disposed of.
