02. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. Satapathy, learned Standing Counsel appearing for the review Petitioner and Mr. Shakti Sekhar, learned counsel appearing for the Private Opp. Party.

3. The present application for recalling/review of order dtd.17.05.2017 has been filed by the Department inter alia on the main ground that the matter at the relevant point of time was assigned to a Division Bench and all through the matter was heard by the Division Bench. But on 17.05.2017 the learned Single Bench disposed of the matter though he was not competent to take up the same.

4. In view of such stand taken by the learned Standing Counsel appearing for the Review Petitioner, this Court deems it fit and proper to recall the order dtd.17.05.2017. While recalling the same, the review Petition is allowed & disposed of. (Biraja Prasanna Satapathy) Judge P.T.O.
