Heard learned counsel for the petitioner and learned Addl. Standing Counsel for the State.

The petitioner is in custody since 18.09.2021 in connection with Adava P.S. Case No.97 of 2021 corresponding to G.R. Case No.100 of 2021 pending in the Court of learned Special Judge-cum-Sessions Judge, Gajapati, Paralakhemundi for the alleged commission of offence under Sections 20(b)(ii)(C)/25/29 of NDPS Act read with Sections 468/471 of IPC.

It is alleged that the petitioner was transporting contraband weighing 65 kg 600 grams ganja in a car when he was apprehended.

It is submitted that the petitioner was merely a passenger in the car which he had taken on hire.

Considering the submissions as above, the materials on record and the period of detention in custody without commencement of trial, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial Court on each date of posting of the case without fail.
