This matter is taken up through Hybrid Mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

Being aggrieved by the order dated 16.03.2007 by which the NBW was issued against the Petitioner in G.R. Case No. 718 of 1997 on the file of learned J.M.F.C., Salipur, corresponding to Mahanga P.S. Case No. 253 of 1997, under Section 379/34 I.P.C. 4.
While prima facie, this Court does not find any infirmity in the order passed but in order to allow the Petitioner to effectively defend himself, it is directed that in the event the Petitioner surrenders within a period of three weeks hence, he shall be released on bail.

It is made clear that, in the event the Petitioner do not surrender within the time fixed, it shall be open to the prosecution to take effective steps in terms of the impugned order. 6.
While being released on bail, it is directed that the Petitioner shall furnish his mobile number and email I.D., if any. 7.
The CRLMC accordingly stands disposed of.
