Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.701 of 2022, pending in the file of learned J.M.F.C., Chandikhol, arising out of Badachana P.S. Case No.150 of 2022, for commission of alleged offences under Sections 294/506/302/34 of IPC. 3.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned District & Sessions Judge, Jajpur by order dated 20.09.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the recitals in the FIR, this Court is not persuaded to consider this application at this stage during the currency of investigation without having the benefit of such consideration by the learned Court in seisin post charge sheet.

Hence liberty is granted to the petitioner to move the learned Court in seisin post charge sheet which shall be considered on its own merits.

Accordingly, the BLAPL stands disposed of.
