This matter is taken up through Hybrid Mode.

Order No 2.

Heard the learned counsel for the Petitioner and learned counsel for the State.

In spite of the notice having been issued since 13.02.2015, no counter affidavit has been filed by the opposite parties, in a case for appointment under the provision of Rehabilitation Assistance Scheme as revealed from Annexure-5.

The then D.I of School, Sonepur vide letter dated 7.9.2010 addressed to the Director Elementary Education, Odisha, Bhubaneswar-opposite party No.2 has made a request to consider the case of the Petitioner by condoning the delay.

It is the submission of the learned counsel for the Petitioner that in spite of such recommendation made on

// 2 // 7.9.2010, when no decision was taken, the Petitioner made an application before the opposite party No.2 on 4.1.2012 under Annexure-7. It is the also submission of the learned counsel for the Petitioner that till date, no decision has been taken on such prayer of the Petitioner as made under Annexure-7.

Taking into account the ground taken in the Writ Petition and the recommendation made by the then D.I. of School, Sonepur on 7.9.2010, the opposite party No.2 is directed to take a decision on the claim of the Petitioner as made under Annexure-7 to the Writ Petition on its own merit within a period of three months from the date of communication of the order. The order so passed be also communicated to the Petitioner.

With the aforesaid observation and direction, the Writ Petition stands disposed of.
