Ramakanta Nayak v. Union Of India
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P. (C) No. 29848 of 2022 Ramakanta Nayak .....
Petitioner Mr. P.K. Sahoo, Adv.
Vs.
Union of India and others .....
Opposite Parties Central Government Counsel
CORAM:
DR. JUSTICE B.R. SARANGI
ORDER
10.11.2022 Order No.
01.
This matter is taken up through hybrid mode.
2.
Heard Mr. P.K. Sahoo, learned counsel for the petitioner. 3.
The petitioner has filed this writ petition challenging the order of suspension dated 27.10.2022 passed by the Director, Institute of Physics, Bhubaneswar under Annexure-9, pending contemplation of disciplinary proceeding initiated against the petitioner.
4.
Mr. P.K. Sahoo, learned counsel for the petitioner contended that there is long standing dispute with regard to fixation of scale of pay due to which time and again the petitioner approached the authority. Therefore, the order of suspension has been passed by the authority.
5.
But on perusal of the order itself, it does not indicate the presumption which has been stated by learned counsel for the petitioner. In any case, since pending contemplation of disciplinary proceeding initiated against the petitioner, he has approached this Court and nothing has been placed on record as to why the petitioner has challenged the same, nor any reason has been indicated for challenging the order of suspension, this
Court is not inclined to entertain this writ petition. However, if the petitioner is being aggrieved by any action of the authority, he may approach the appropriate forum in accordance with law. 6.
With the aforesaid liberty, the writ petition stands disposed of.
