Yoshoda Khandeitaray v. State Of Odisha
IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P.(OAC) No.581 of 2012 Yosada Khandayatray ....
Petitioner Mr. K.P. Mishra, Advocate -versusState of Odisha .... Opposite Parties Mr. A. Dash, ASC CORAM: JUSTICE S.K. PANIGRAHI
ORDER
03.03.2022 Order No.
02.
1. The matter is taken up through hybrid mode.
2. The present petitioner belonging to unreserved candidate stood first under the unreserved women for the post of constable in the district of Khurda. But, the post earmarked for women (UR) has been filled up by the SC and SEBC candidates, which is contrary to the law laid down by the Hon'ble Apex Court. Therefore, the petitioner has carved indulgence of this Court for a direction in order to rectify that anomaly.
3. Since the case was filed in 2012 and the entire selection process might have been over today, there seems to be no cause of action survives.
4. Hence, the writ petition is disposed of as infructuous.
5. The petitioner is granted liberty to file writ petition afresh, if any cause of action survives.
