This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for both the parties.

The present writ petition has been filed challenging the actions of the opposite parties in imposing the punishment vide order dated 21.08.2015 stopping one increment without cumulative effect and treating the period of suspension as such on the ground that such action is illegal and arbitrary.

It is submitted by learned counsel for the Petitioner that the Petitioner has preferred an appeal, which is pending before the Commissioner-cum-Secretary, Fisheries and Animal Resources Development Department, Odisha, Bhubaneswar-Opposite Party No.1. The appeal memo reveals that the same is still pending as of now.

Learned counsel for the State submits that he has no objection,
// 2 // if a direction be given to the Opposite Party No.1 to dispose of the appeal memo within a stipulated period.

In such view of the matter, without expressing any opinion on the merits of the case, this Court disposes of the present the writ petition with a direction to the Opposite Party No.1 to consider and dispose of the appeal memo dated 03.10.2015 under Annesxure-8 within a period of four weeks from the date of production of certified copy of this order. It is needless to mention here that the Opposite Party No.1 shall do well to consider and dispose of the appeal memo of the Petitioner after giving opportunity of hearing and the same be disposed of by passing a reasoned and speaking order. The decision so taken on the same shall be communicated to the Petitioner within a period of ten days thereafter.

With the aforesaid observation, the writ petition stands disposed of.

Urgent certified copy of this order be granted on proper application.
