Heard Mr. D.Pattanayak, learned counsel for the Petitioner and Mr. B.Das, learned counsel for the Accountant General, Odisha, Bhubaneswar.

This Present Writ Petition has been filed by the retired employee with the allegation that he has not been released with his death-cum- retirement gratuity benefit. The petitioner also prayed for payment of interest on the said claim. As reflected from Annexure-3, the Accountant General (A & E), Odisha, Bhubaneswar has been forwarded with relevant documents for sanction of the benefit in favour of the Petitioner.

It is submitted by the learned counsel for the Petitioner that in spite of such communication, no decision has been taken by the Accountant General in releasing the gratuity in favour of the Petitioner.

Since in spite of the notice, no counter affidavit has been filed either by the State Counsel or by the Accountant General I deem it proper to permit the petitioner make a detailed representation before the Accountant General (A&E), Odisha, Bhubaneswar within a period of three weeks from today with a prayer to sanction the retirement gratuity. If such an application is filed within the aforesaid period, the Accountant General (A&E), Odisha, Bhubaneswar is directed to take a decision on the same within a period of one month thereafter. It is also directed that the amount towards retirement gratuity since has not been released till date, the Petitioner will be entitled to get interest @ 6 % Per Annum all through.

With the aforesaid observation and direction, the WPC(OAC) stands disposed of.
