1. Heard learned counsel for the Petitioner and the State.

2. This is an application for bail U/s.438 Cr.P.C. filed by the Petitioner in apprehension of arrest for his alleged involvement in the offences U/s.467/468/471/409/420/34 IPC.

3. Learned counsel for the State submits that the enquiry report in respect to the allegation of misappropriation of HSY financial assistance in Hatadiha Block of Keonjhar district substantially implicates the Ex Sarapanch.

4. Learned counsel for the Petitioner submits that the name of the present Petitioner does not find place in the enquiry report or the FIR. It is ascertained that the present Petitioner joined the place in the period to which the allegations do not relate.

5. In such view of the matter, the apprehension of the Petitioner is called for.

6. With the above observation, the Petitioner is permitted to withdraw the bail application with liberty to file afresh if any cause of action arise. Accordingly, the ABLAPL is disposed of as withdrawn with the liberty as prayed for.
