1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.
2. Heard Ms. P. Priyambada, learned counsel for the Petitioner and Mr. A.P. Das, learned Addl. Standing Counsel appearing for the Opp. Parties.
3. Pursuant to the order passed by this Court on 24.02.2022 and 21.10.2022 Mr. Das, learned ASC produced the instruction provided by the Under Secretary, MS & ME Department. From the instruction it is found that during pendency of the Departmental Proceeding the Petitioner retired from his service on 28.02.2014 on attaining the age of superannuation and subsequently died on 03.10.2014. Accordingly, the Disciplinary Proceeding drawn up against the Petitioner vide Memorandum dated 16.04.2011 was dropped vide MS& ME Department Office Order No. 3948/MSME dated 01.07.2017 as per G.A. Department Circular No. 19806/Gen dated 21.08.2012. Thereafter, the wife of the deceased employee has been sanctioned with the retiral benefits in the meantime.

4. In view of the same, nothing remains to be decided in the writ petition and accordingly, the writ petition is disposed of. (Biraja Prasanna Satapathy) Judge Sneha
