This matter is taken up through Hybrid Mode.

Order No 2.

Heard Mr. S.K. Purohit, learned counsel for the petitioner and Mr. Panigrahi, learned A.S.C.

The petitioner has filed the present writ petition with the following prayer.

"To declare the Selection of Foresters by the Respondent No.2 (two) and 3 (three) as illegal and arbitrary.

As there are still vacancy appears (Annexur-13) , the Respondent No.2(two) be directed to absorb the applicant therein"

This Court after going through the materials available on record and the stand taken in the counter affidavit finds that against three posts advertised, the Selection Committee has rightly selected two candidates from UR and one candidate from S.C category and the petitioner's position is at Sl. No.4 under U.R category.

Taking into account the vacancy available and the position of the petitioner in the merit list, the prayer as made in the Writ Petition cannot be allowed.
