The Original Application No. 1346(C) of 2013 was filed before the Odisha Administrative Tribunal, Cuttack Bench, Cuttack. After its abolition, the same has been transferred to this Court which is renumbered as WPC (OAC) No. 1346 of 2013.

Being aggrieved by non-consideration of candidature of the petitioner for promotion to the rank of D.S.P. i.e. in the Cadre of O.P.S.(I) (J.B.) has filed the Original Application numbered as O.A. No.1346 (C) of 2013 which is converted to WPC(OAC) No.1346 of 2013 after the said Tribunal being abolished. The petitioner also sought to challenge the modification carried out in gradation list of the Inspectors of Police without inviting objection thereby granting scope for the juniors to get the promotion.

The learned Tribunal vide order dated 24th May, 2013 while issuing notice declined to pass any interim order. 4.

When the matter is taken up today, Mr. B. K. Routray, learned counsel for the petitioner submitted that by efflux of

// 2 // time, the matter has been rendered infructuous and the petitioner is no more interested to pursue the matter. 5.

In view of such submission, the Writ Petition stands disposed of as infructuous.
