2. Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

3. The petitioner is in custody since 03.04.2021 in connection with Pipili P.S. Case No. 177 of 2021 corresponding to G.R. Case No. 233 of 2021 pending in the court of learned J.M.F.C., Pipili for the alleged commission of offence under Sections 302/304 of IPC.

4. The allegation is that the petitioner who is one of the inmates of a rehabilitation centre by the name of Disha Foundation assaulted the deceased, who was also an inmate, and caused his death.

5. Learned counsel for the petitioner submits that the medical evidence does not corroborate the statement of the witnesses and more over, the other accused persons, who stand on same footing as the present petitioner have already been released on bail.

6. Learned Additional Standing Counsel for the State, on the other

hand, has opposed the prayer for bail by submitting that there are strong prima facie materials to suggest the complicity of the petitioner in the occurrence.

Having regard to the submissions made, the materials on record, the period of detention already undergone and the fact that the coaccused persons, who stand on similar footing have already been granted bail by this Court in BLAPL Nos.7598, 8374 and 8991 of 2021, I am inclined to allow the prayer for bail. Let the petitioner be released on bail on such terms and conditions as the court in seisin over the matter may deem fit and proper to impose including the condition that he shall personally appear before the trial court on each date of posting of the case without fail.

5. The BLAPL is accordingly disposed of.

6. Urgent certified copy of this order be granted on proper application.
