This matter is taken up by hybrid mode.
1. Learned counsel for the petitioner submits that as per the up-to-date instruction from the petitioner, the petitioner has filed a written statement of defence in disciplinary proceeding pursuant to the order dated 17.10.2011.
2. The long pendency of the original application has not helped the matter in any manner whatsoever as the disciplinary proceeding initiated way back in the year 2011, got protracted.
3. The writ petition is disposed of observing that if the disciplinary proceeding is still pending before the authority, the same shall be disposed of after considering the written statement of defence submitted by the petitioner and following the due procedure of law as expeditiously as possible, preferably within a period of six months from the date of communication of the certified copy of this order.
4. It is clarified that this Court has not expressed any opinion on the merits of the case in any manner whatsoever. (M.S.Sahoo) dutta Judge
