CORAM:

JUSTICE M.S.SAHOO Order No.

ORDER

18.2.2022 1.

1. This matter is taken up by hybrid mode.

2. The matter having been transferred from the learned Odisha Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition, has been registered as a writ petition before this Court on 29.11.2021.

3. On perusal of the available order sheets of the learned Tribunal, it is indicated that the matter was never taken up after 20.7.2017.

4. It is submitted by learned counsel for the petitioner that he does not have up-to-date instruction to prosecute the present litigation on behalf of the petitioner.

6. The Original Application was filed before the learned Tribunal challenging the advertisement and the consequential selection procedure for the post of Forest Guard in different divisions under the Forest Department, Govt. of Odisha as per Recruitment Rules, 1998. The applicant contended that interview and the selection process suffer from several irregularities and liable to be set aside. A counter affidavit has been filed on behalf of O.P. NO.3 refuting the allegations of the applicant.

7. It is submitted by learned AGA that due to long pendency of the case, the rights in favour of the selected candidates have crystalised not having been made parties in the O.A. and further the writ petition has been rendered infructuous by efflux of time.

8. In view of the above, the writ petition is disposed of with liberty to the petitioner to revive the same within ninety days for any surviving cause of action.
