Mr. Bose, learned advocate appears on behalf of petitioner and submits, challenge in the writ petition is against interim order passed by the Revenue Divisional Commissioner, Central Division, Cuttack (opposite party no.1). The matter is fixed for final hearing on 23rd December, 2022. In that view of things, his client will avail opportunity of final hearing and not press the writ petition. 2.

Opposite party no.4 appears in person and opposes the contention of petitioner. He submits, false allegations have been made

// 2 // in the writ petition. Mr. Nanda, learned advocate, Additional Government Advocate appears on behalf of State. 3.

We accept petitioner's contention of wanting to agitate on having final adjudication before the authority. As such, no order need be made on the writ petition. It goes without saying that allegations made in it cannot be deemed to have been admitted by opposite parties.
