The original application was filed in the year 2012 by the applicant when he was working as Assistant Teacher in Rampur Koliani Nodal U.P. School, Brajaraj Nagar in the district of Jharsuguda, challenging the recovery of Rs.78,697/- on the allegation of excess drawal of house rent allowance.
It is submitted by the learned counsel for the petitioner that he has no up-to-date instructions from the petitioner to pursue the litigation at present. It is submitted by the learned Standing Counsel for the School and Mass Education Department that as indicated in the counter dated 26.11.2012, the action taken against the petitioner for recovery of the house rent allowance is just and proper, in view of the fact that she has been provided with a rent free accommodation.
