Opp. Parties Mr. Dillip Kumar Mishra, Additional Government Advocate
CORAM:
JUSTICE K.R. MOHAPATRA
ORDER
Order No.
05.05.2022 01.
1.
This matter is taken up through hybrid mode.
2.
On the oral prayer of Mr. Tripathy, learned counsel for the Petitioner, he is permitted to implead the State of Odisha represented through its Commissioner-cum-Principal Secretary, Revenue and Disaster Management Department, Government of Odisha, Bhubaneswar as Opposite Party No.1 to the writ petition in Court itself.
3.
This writ petition has been filed for a direction to the Commissioner, Consolidation, Odisha, Cuttack-Opposite Party No.2 for early disposal of R.C. Case No.251 of 2014. 4.
Mr. Mishra, learned Additional Government Advocate, on instruction, submits that the matter was last posted on 20th December, 2021 for hearing.
5.
On perusal of the writ petition, it appears that this Court in an earlier occasion vide order dated 3rd May, 2016 passed in W.P.(C) No.6937 of 2016 directed the Commissioner, Consolidation, Odisha, Cuttack to dispose of R.C. Case No.251
// 2 // of 2014 within a period of six months. But it is not known as to why the matter is neither disposed of within the period stipulated by this Court nor any prayer for extension of time has been made to that effect.
6.
However, from the submission of Mr. Mishra, learned Additional Government Advocate, it appears that the revision is ready for hearing.
7.
Hence, this Court taking a lenient view in the matter disposes of this writ petition directing the Commissioner, Consolidation, Odisha, Cuttack-Opposite Party No.1 to dispose of R.C. Case No.251 of 2014 as expeditiously as possible preferably by the end of September, 2022.
8.
A copy of this order be handed over to Mr. Mishra, learned Additional Government Advocate for communication and compliance.
Urgent certified copy of this order be granted on proper application.
