This matter is taken up through hybrid mode.

This CMP has been filed for a direction to learned Civil Judge (Junior Division), Bhubaneswar to dispose of I.A. No.1 of 2017 (arising out of C.S. No.11 of 2017) filed under Order XXXIX Rules 1 and 2 C.P.C. at an early date.

On perusal of the order sheet, it appears that the Petitioner, who is the Opposite Party in the I.A., has already filed her objection. But, due to non-cooperation of learned counsel for the parties, I.A. No.1 of 2017 could not be disposed of.

In view of the above, this Court disposes of the CMP with a direction to learned counsel for the parties to cooperate with learned trial Court for early disposal of I.A. No.1 of 2017, if the same is still pending.

Since it is an application under Order XXXIX Rules 1 and 2 C.P.C., learned trial Court shall also make an endeavour for its early disposal, if there is no legal impediment. Urgent certified copy of this order be granted on proper application.
