Heard learned counsel for the parties.

The petitioner has filed this writ petition seeking direction to opposite parties no.1 to 3 to disburse the differential arrear salary as well as the pension with revised current pension in Trained Graduate scale w.e.f 07.03.2009 taking into view the date of attaining the age of 48 years as per Rule-16(2) of the Orissa Education Rules 1974 vide Annexure-6 on the basis of the S.M.E. Dept. Letter No.6259 dated 16.04.2010 to the Director, Secondary Education vide annexure-8 and earlier application of the petitioner dated 26.03.2010 vide Annexure-8 with cost and further to issue direction to opposite party no.3 to finalize his representation vide Annexure-10 within a stipulated period.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to opposite party no.3 vide Annexure10 and the same may be directed to be considered and disposed of taking into consideration Annexures-6, 7, 8 & 9 within a stipulated time, to which learned State Counsel has

raised no objection.

As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.3 to consider the representation filed by the petitioner vide Annexure-10 and pass appropriate order in accordance with law taking into consideration Annexures-6, 7, 8 & 9 within a period of three months from the date of production of certified copy this order.
