Heard learned counsel for the parties.

The petitioners have filed this writ petition seeking direction to the opposite party no.3 to take steps for disbursal of differential claimed dues, i.e. increment and D.a. w.e.f. 22.09.2007 as enhanced in the notification dated 22.09.2007, as per Orissa Education (Payment of grant-in-aid to the High Schools, Upper Primary Schools etc. Amendment Order, 2007.

In course of hearing, learned counsel for the petitioners states that highlighting the grievance, the petitioners have made representation to the opposite party no.2 vide Annexure-10 and direction may be given to consider and dispose of the same, taking into account Annexure-9 within a stipulated time, to which learned State Counsel has no objection.

As agreed to by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes of the writ petition directing the opposite party no.2 to take a decision on the representation filed by the petitioners vide Annexure-10, taking into account Annexure-9 and pass appropriate order in accordance with law, within a period of three months from the date of production of certified copy of this order by the petitioner. 6.

Issue urgent certified copy as per rules.
