RJ This matter is taken up through hybrid mode.
The writ petition has been registered before this Court on 2nd December, 2021, after the original application was transferred from the learned State Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition.
On perusal of the available order sheets of the learned Tribunal, it is indicated that matter was never taken up after 11.09.2013.
The petitioner/applicant who was aged about 51 years had filed the original application in the year 2013, while working as Senior Clerk, Department of Civil Supplies, Sundargarh, inter alia praying for a direction to the opposite parties to give him promotion to the rank of Head Clerk.
It is submitted by the learned counsel for the petitioner that he has no up-to-date instruction to purse the litigation at present.
Learned Addl. Govt. Advocate submits that due to
// 2 // long lapse of time about nine years, nothing would survive in the present writ petition for adjudication and also the petitioner would have retired in the year 2021 on attaining age of superannuation.
Accordingly, the writ petition is disposed of due to lack of instructions from the petitioner granting liberty to revive the same within sixty days for any surviving cause of action.
