IN THE HIGH COURT OF ORISSA AT CUTTACK

WPC(OAC) No. 3043 of 2012 Keshaba Chandra Jena ....

Petitioner None -versusState of Odisha & others ....

Opp. Parties Mr. Dhananjay Mund, Addl. Govt.

Advocate

CORAM:

JUSTICE M.S. SAHOO Order No.

ORDER

03.03.2022 02.

This matter is taken up through hybrid mode.

RJ None appears for the petitioner.

When the matter was taken up on 17.02.2022, none had appeared for the petitioner. It was noted that the matter was never taken up after 04.09.2013 during pendency before the learned Tribunal till it was listed before this Court on 17.02.2022, after being registered as a writ petition on 29th November, 2021.

It is again reiterated by the learned Addl. Govt. Advocate that the matter would have become infructuous, as the original applicant had challenged the process of walk-ininterview for the post of MPHW (Male) (Contractual) that was held by the opposite party no.3 on 23.08.2012. It is submitted that the period of contract would have been long since over rendering the petition infructuous.

Having heard learned Addl. Govt. Advocate, the writ petition is disposed of having become infructuous granting liberty to the petitioner to revive the same within ninety days for any surviving cause of action.

(M.S. Sahoo) Judge
