1. This matter is taken up by hybrid mode.
The Original Application having been transferred from the learned Orissa Administrative Tribunal, Cuttack Bench, Cuttack upon its abolition, has been registered before this Court on 2.12.2021.
2. On perusal of the available order sheets of the learned Tribunal it is indicated that the matter was never taken up after 24.5.2013.
3. The O.A.
was filed in the year by the applicant/petitioner before the learned Tribunal when he was working as Opthalmic Assistant, Community Health Center, Jagannath Pasad, Dist. Ganjam, inter alia, seeking a direction to declare the cadre of Opthalmic Assistants as a district cadre with a further payer not to disturb him from his then place of posting, i.e., Community Health Center, Jagannath Pasad, Dist. Ganjam.
4. Learned counsel for the petitioner submits that he does not have up-to-date instruction from the petitioner to pursue the litigation.
5. Learned AGA relying on the counter verified on 9.4.2015 filed by O.P. No.4-CDMO, Ganjam, Berhampur, submits that during pendency of the Original Application, O.P. No.1-
// 2 // Govt., Health & Family Welfare Department vide office order dated 15.9.2014, has declared the cadre of Opthalmic Assistants as a district cadre. Accordingly, the petitioner has been granted the relief as prayed for and no cause of action survives.
6. Having hearing learned counsel for the parties, the writ petition is disposed of as not pressed.
