None appears for the petitioner.

When the matter was taken up on 17.02.2022, none had appeared for the petitioner. It was noted that the matter was never taken up after 23.11.2012 during pendency before the learned Tribunal till it was listed before this Court on 17.02.2022, after being registered as a writ petition on 29th November, 2021.

It is submitted by the learned Addl. Govt. Advocate that the petitioner was 53 years of age when he filed the original application before the learned Tribunal. It is further submitted that the prayer made in the original application was to finalise the gradation/seniority list of the Section Officer (Level-I) by adopting "catch up" principle and to give promotion to the petitioner. It is further submitted that by efflux of time, the writ petition has been rendered infructuous and therefore the same may be disposed of.
