Petitioner in this CMP seeks to assail the order dated 3rd March, 2020 passed by learned District Judge, Ganjam at Berhampur in FAO No.24 of 2019, whereby he reversed the order dated 2nd May, 2019 passed by learned Civil Judge (Junior Division), Berhampur in IA No.2 of 2019 (arising out of CS No.4 of 2019) allowing an application under Order XXXIX Rules 1 and 2 CPC.

In course of hearing, learned counsel for the Petitioner files a memo for withdrawal of the CMP, which is taken on record.

In view of the memo filed, the CMP is dismissed as withdrawn.
