1.This matter is taken up by hybrid mode.

2. None appears for the petitioner at the time of call.

3. The petitioner has approached before the Tribunal in the year 2012 challenging the illegal action of the opposite parties in not paying the pension and other retiral benefits of the petitioner from the date of his retirement and seeking direction to the opposite parties to pay his pension and other benefits after retirement.

4. Since the petition was filed in the year 2012 and in the meantime more than nine years have already been passed. During the said period the cause of action must have been extinguished.

5. In such view of the matter, the WPC(OAC) is disposed of as infructuous.

6. However, liberty is granted to the petitioner to approach this Court afresh, if any cause of action survives. ( S.K. Panigrahi) Judge
