The petitioner has filed this writ petition seeking to quash the order dated 17.09.2012 under Annexure-10, and to issue direction to the opposite parties to sanction the incentive allowance (green card) w.e.f. the date of joining in the work charged establishment, i.e., 01.12.2009 and release the said benefit within a stipulated time.

Having heard learned counsel for the petitioner and after going though the records, this Court finds that the petitioner claims for grant of incentive allowance (green card) under the work charged establishment and further claims that the same should be given effect to from later date, as the petitioner is entitled to the same. But the petitioner is not entitled to avail such benefits from a later date, on his brought over to work charged establishment, as the date of admissibility cannot be shifted to a later date. 4.

In the above view of the matter, this Court does not find any merit in the writ petition, which is accordingly dismissed. (Dr. B.R. Sarangi) Judge Ashok
