Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.1020 of 2022, pending in the file of learned S.,D.J.M., Deogarh, arising out of Barkote P.S. Case No.393 of 2022, for commission of alleged offences under Sections 379/411/34 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Asst. Sessions Judge, Deogarh by order dated 02.11.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted the petitioner is in custody since 28.08.2022 and on the basis of order of rejection, it is submitted that since final form has already been submitted, he may be released on bail. 5.

Learned counsel for the State opposes the prayer for bail in view of series of criminal antecedents of the petitioner. 6.

Taking into account the period of custody in the case at hand and the punishment prescribed, this Court directs the

petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.

Since the petitioner is a resident of village Rengali under Mahulpada police station, it is directed that he shall appear once every week before the said police station on such date and time fixed by the learned Court in seisin for the next six months. 8.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
