Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T Case No.1033 of 2022 pending on the file of learned S.D.J.M., Deogarh, arising out of Deogarh P.S. Case No.656 of 2022, for commission of offence alleged under Section 25(1)(a) of the Arms Act. 3.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Deogarh by order dated 01.11.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Learned counsel for the Petitioner submits that the Petitioner is in custody since 29.08.2022 and as charge sheet is filed on 27.10.2022, his further continuance in custody is not warranted. The copy of the final form filed in Court be kept on record.

Learned counsel for the State opposes the prayer for bail. 7.

Taking into account the period of custody and filing of the charge sheet, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view the criminal proclivity of the Petitioner, additionally, it is directed that the Petitioner shall appear before the jurisdictional police station once every week till conclusion of trial. 9.

The BLAPL thus stands disposed of.
