Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are accused in G.R. Case No.250 of 2022, pending in the file of learned G.N.-cum-J.M.F.C., Odagaon, distNayagarh, arising out of Sarankul P.S. Case No.117 of 2022, for commission of alleged offences under Sections 379/34 of IPC. 3.

Being aggrieved by the rejection of their application for bail U/s.439 Cr.P.C. by the learned Asst. Sessions Judge, Odagaon by order dated 31.10.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted that the petitioners are in custody since 30.09.2022 and on perusal of the order of rejection, it is seen that the charge sheet has already been filed.

Taking into account the period of custody and filing of charge sheet and considering the nature of allegation and punishment prescribed, this Court directs the petitioners to be

released on bail on such terms to be fixed by the learned Court in seisin.

Additionally, it is directed that the petitioners shall appear before the jurisdictional police station once every week on such date and time be fixed by the learned Court in seisin till submission of final form.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
