Claiming trained graduate scale of pay and seniority from the date of acquisition of B.Ed. qualification, the petitioner has approached this Court by filing the present writ petition. He further seeks direction to the opposite parties no.1 to 3 to release the arrear differential salary in the trained graduate scale of pay w.e.f. 01.06.1983 to 14.06.1989. 3.

Mr. S.D. Routray, learned counsel for the petitioner contended that the case of the petitioner is squarely covered by the judgment of this Court in the case Jasobanta Mohanty v. State of Orissa, 122 (2016) CLT 661 and in the case of Smt. Sujata Das v. State of Orissa (W.P.(C) No. 12440 of 2012 disposed of on 10.03.2021). Therefore, direction may be given to the opposite parties to consider the case of the petitioner taking into consideration the aforesaid judgments of this Court within a stipulated time, to which learned State Counsel has raised no objection.

As agreed by learned counsel for the parties, without expressing any opinion on the merits of the case, this writ petition stands disposed of directing opposite parties to consider the case of the petitioner taking into consideration the judgments of this Court in the cases of Jasobanta Mohanty v. State of Orissa, 122 (2016) CLT 661 and in the case of Smt. Sujata Das v. State of Orissa (W.P.(C) No. 12440 of 2012 disposed of on 10.03.2021), and pass a reasoned and speaking order as expeditiously as possible, preferably within a period of three months from the date of receipt of the certified copy of this order.

Issue urgent certified copy as per rules.
