Heard the learned counsel for the Petitioner and learned counsel for the State.

The Petitioner has filed the present Writ Petition inter alia with the following relief:- "i) Order R. Nos.1 and 2 to promote the applicant as Assistant Conservator of Forests in Group-A of Orissa Forest Service Cadre, despite pendency of disciplinary proceedings beyond 10 years, within a time frame subject to the result of this case; ii) any other order / orders as deem fit and proper; iii) order allowing this application with costs". 4.

It is submitted that during pendency of the matter and vide order dated 06.12.2013, the Petitioner was given promotion to the rank of Assistant Conservator of Forests. It is the contention of the Petitioner that the employees / candidates junior to the Petitioner in the gradation list

// 2 // have availed such benefit much prior to the order issued in favour of the Petitioner and accordingly he claims for retrospective promotion.

Considering such submission, this Court observes that the Petitioner shall make a detailed representation before opposite party No.1 claiming extension of such benefit within a period of three weeks from today. If such a representation is filed within the said period, the opposite party No.1 is directed to take a decision on the same on its own merit within a further period of three months. The order so passed be also communicated to the Petitioner.

With the aforesaid observation and direction, the Writ Petition (OA) stands disposed of.
