Petitioner Mr. N. Biswal, Advocate -versusState of Odisha & others ....
Opp. Parties Mr. P.K. Muduli, AGA
CORAM:
JUSTICE M.S. SAHOO Order No.
ORDER
29.09.2022 02.
RJ 1.
This matter is taken up through hybrid mode.
2.
It is submitted by the learned counsel for the petitioner that despite his effort, he has not been able to contact the petitioner.
3.
Earlier, when the matter was listed on 18.02.2022, the matter was adjourned to seek up-todate instruction from the petitioner as the petition was filed in the year 2012.
4.
Learned Addl. Govt. Advocate referring to the averments made in the writ petition (O.A.) submits that considering the nature of grievance raised in the writ petition i.e. fixation of pay as per the ORSP Rules, 1996 and 2006, after a long lapse of time due to the coming into effect of the subsequent pay revision rules, nothing would survive at present, as in all likelihood, the salary of the petitioner would have been revised as per the latest ORSP Rules.
5.
Having heard learned counsel for the parties, the
// 2 // writ petition is disposed of granting liberty to the petitioner to revive the petition within sixty days for any surviving cause of action.
