01. 1. This matter is taken up through Hybrid Arrangement Order No (Virtual/Physical) Mode.

2. Heard Mr. A.K. Chhatoi, learned counsel for the Petitioner and Mr. M.K. Balabantaray, learned Standing Counsel appearing for the State-Opp. Parties.

3. The Petitioner challenges the order of punishment passed on 26.12.2016 under Annexure-4. It is submitted by Mr. Balabantaray that the Petition issued with the said order of punishment because of his conviction and sentence passed in VGR Case No. 21 of 2002. It is further submitted that challenging such order of conviction the Petitioner approached this Court in Criminal Appeal No.371/2016.

4. Since the impugned order has been passed basing on the order of conviction and sentence passed against the Petitioner, this Court finds no illegality or irregularity in the same and accordingly this writ Petition is not entertainable and dismissed.

5. However, it is observed that the said impugned order shall be subject to the final outcome in Criminal Appeal No. 371 of 2016. (Biraja Prasanna Satapathy) Judge Sneha
