The matter is taken up through hybrid mode.

Mr. G.P. Dutta and Associates enters appearance for insurer - Respondent No.2. Their names be indicated in the list as well as on the brief.

Heard Mr. K.C. Nayak on behalf of Mr. B.N. Samantaray, learned counsel for the claimant - Appellant and Mr. S.K. Mohanty, learned counsel for insurer - Respondent No.2. 4.

It is seen that there is delay of 497 days in filing the appeal. The appeal is for enhancement of the compensation amount. 5.

It is seen that the reasons for delay is stated to be due to the conducting advocate, who did not file the same in time. But nothing has been mentioned in the petition regarding the date of handing over the brief to the Advocate and when instruction was given. The petition

has been drafted in a casual manner. Accordingly, this court is not inclined to condone the limitation. The I.A. is dismissed. 6.

Resultantly, the appeal is also dismissed on the ground of limitation.
