Heard learned counsel for the Parties.

Order No.

Even though there is allegation of no full compliance of the direction of the Tribunal in reference to the query and answer therein in an intra-departmental communication, Mr.K.K.Swain, learned counsel for the Petitioner alleged that for their own submission, they are awaiting for sanction of money, there lies contempt and the Contemnor should be proceeded under the Contempt of Courts Act. 3.

However referring to the plea taken in the compliance affidavit of the Department, Mr.R.K.Samal, learned Standing Counsel submitted that there has been appearance of dispute involving some period, which cannot be worked out.

For the nature of litigation involving the Contempt Petition, this Court finds, the Contempt Court has no jurisdiction to enter into such controversy. In the event the Petitioner so advised may bring appropriate litigation for determination of the issue involved herein. 5.
