This matter is taken up through hybrid mode.

The petitioner has filed this writ petition seeking direction to opposite party no.1 to regularize the service of the petitioner from 05.11.2008 to 22.01.2009 as extension of joining time under Rule-2008 of O.S.C. and to pay the arrear dues with interest within a stipulated time.

In course of hearing, learned counsel for the petitioner states that the case of the petitioner has already been recommended by opposite party no.5 to the opposite party no.1 vide Annexure-9 dated 08.10.2009 and, therefore, direction may be given to take a decision on the same within a stipulated time, to which learned State Counsel has raised no objection.

As agreed by learned counsel for the parties, this Court disposes of the writ petition directing opposite party
no.1 to take a decision on the recommendation made by the opposite party no.5 under Annexure-9 dated 08.10.2009, and pass appropriate in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of receipt of certified copy of this order. Issue urgent certified copy as per rules.
