1. This matter is taken up by hybrid mode.
2. None appears for the petitioner when the matter is called.
3. When the matter was last taken up on 08.04.2022 after hearing learned Standing Counsel and considering the matter in some detail, the following order was passed : " The Original Application having been transferred from the learned Orissa Administrative Tribunal, Bhubaneswar upon its abolition, has been registered before this Court as a writ petition on 12.8.2021.
2. On perusal of the available order sheets of the learned Tribunal it is indicated that notices were issued on 12.11.2013 and the matter was never taken up thereafter.
3. The applicant before the learned Tribunal was aged 51 years and filed the O.A. in the year 2013 challenging the order dated 8.11.1990 (Annexure-4) passed by the Director, Elementary Education, Odisha (O.P. No.3) granting promotion to a group of teachers of Level III service of Elementary cadre to Level II service.
4. Learned Standing Counsel referring to the averments made in the Original Application submits that the petitioner was working as an Assistant Teacher in the Jr. Secondary Education Service cadre (TGT) in a Govt. High School when he filed the Original Application and as such may not have any grievance regarding promotion from Level III to Level II
// 2 // which are different to the cadre of the petitioner. It is submitted that in effect the petitioner is not an aggrieved party and nothing would survive after a long lapse of time as the petitioner would have retired in the year on attaining the age of superannuation.
5. Having heard learned Standing Counsel, the matter is adjourned to 20.4.2022 to grant another opportunity to the petitioner."
4. Learned Standing Counsel reiterates the submissions on behalf of the State as noted in the order dated 08.04.2022.
