This matter is taken up through Hybrid Mode.

The petitioner is an accused in connection with G.R. Case No. 980 of 2020 corresponding to Gosaninuagaon P.S. Case No. 87 of 2020, pending on the file of the Learned S.D.J.M., Berhampur for the alleged commission of offence under Sections460/396/302 of the IPC, and is in custody since 19.06.2020. 3.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge-cumSpecial Judge (Vigilance), Berhampur by Order dtd. 20.11.2020 in Bail Application No. 661 of 2020(T), the present BLAPL has been filed.

Heard Mr. Dibya Jyoti Sahoo, learned counsel for the petitioner, Mr. S.R. Nayak, learned Additional Government Advocate for the State and Mr. Dharanidhar Nayak, learned Senior Counsel appearing for the informant.

Taking into account the materials on record, the statement under Section-27 of the Evidence Act and the Test Identification (TI) Parade of the materials recovered and the CDR available on record and considering the statement of one Saroj Sahoo @ Liku, this Court is not inclined to entertain the application for bail of the petitioner at this stage. 6.

Accordingly, the BLAPL stands dismissed.

It is open for the petitioner to move this Court at a later stage, if so advised.
