This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

None appears for the Petitioner when the matter is called. Heard Mr.P.C. Das, learned counsel for the State. 3.

The present writ petition has been filed by the Petitioner praying for a direction to the Opposite Parties-Authorities to grant notional promotion to the Petitioner to the post of Head Clerk from the year 1996 and to regularize the period of service of the Petitioner from 1990 till his retirement, periodically increments from the year 1990 and other service benefits with arrear within a stipulated period of time.

Learned counsel for the State submits that they have filed a counter affidavit in this matter and in the counter affidavit, it has been reflected that the amount as due and admissible to the Petitioner had already been disbursed in the meantime. However, he will have no objection, if a direction is given to the Authority to dispose of the

// 2 // representation of the Petitioner dated 30.03.2012 under Annexure-6. 5.

Considering the submission made and since the matter has been decided in absence of learned counsel for the Petitioner, this Court directs the Authority if such representation under Annexure-6 is pending before him, the same shall be considered in accordance with law and dispose of by passing a reasoned and speaking order within a period of two months from the date of production of certified copy of this order. Further, if the Petitioner is entitled to any amount which is due and payable to him, the same shall be paid to him within the aforesaid period.

With the above direction, the writ petition stands disposed of. 7.
