Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.238 of 2022, pending in the file of learned District & Sessions Judge, Kalahandi at Bhawanipatna, arising out of Kesinga P.S. Case No.251 of 2022, for commission of alleged offences under Sections 379 of IPC and is in custody since 15.09.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kalahandi, Bhawanipatna by order dated 30.09.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the period of custody and nature of accusation and the punishment prescribed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin.

Keeping in view the criminal proclivity of the petitioner, this Court directs the petitioner to appear before the I.O. once every week on such date and time be fixed by the learned Court in seisin till submission of final form.

Accordingly, the BLAPL stands disposed of.

Urgent certified copy of this order be granted as per the rules.
